Tissue Donation, Trans + Nonbinary Blood Donation, and Implementation of the FDA's blood donation eligibility from 5/11/2023 are our current priority initiatives. As we make progress on those fronts, we will continue to transition to place a greater focus on the Department of Health and Human Services' 30-day labeling policy for MSM donors.

The HOPE Act

  • The (Human Immunodeficiency Virus) Organ Policy Equity [HOPE] Act is a landmark piece of legislation signed in to law in 2013 by President Obama. 
  • The HOPE Act allows for HIV+ organ donors to donate organs to HIV+ recipients. There is not a risk of HIV transmission because the recipient is already infected. 
  • The policy was initially implemented with kidney and liver transplants in 2015, and was expanded to all organs in 2020. 
  • Although we can't end the queer tissue ban and organ donation policy in the same way- we are looking into similar routes to allow for certain HIV+ donations (ex. heart valves, corneas) to HIV+ recipients to assist with current shortages.
